Under the Investment Advisers Act of 1940 (as amended), a Registered Investment Adviser ("RIA") is "any person who, for compensation, engages in the business of advising others, either directly or through publications or writings, as to the value of securities or as to the advisability of investing in, purchasing, or selling securities..." RIAs receive compensation in the form of management fees rather than commissions. Incentive fees can be charged if certain conditions are met. To become an RIA, a firm files Form ADV with the SEC annually, pays a stipulated fee and meets certain other requirements. While RIA practices vary by firm, they generally: advise concerning appropriate investments based on an assessment of the individual’s needs and risk tolerance; monitor client's portfolios and, as appropriate, recommend changes; and use a broker-dealer or bank to custody assets and to settle and execute trades.

Fee-only financial planners are compensated solely by fees paid by their clients and do not accept commissions or compensation from any other source. Fee-only planners believe that a significant conflict of interest exists when advisors stand to gain financially from the purchase of any investment or insurance product they recommend to the client. Rather than charge a sales commission on each individual transaction, fee-based advisors charge a reasonable annual fee, based on the client’s account value. As a result, fee-only advisors focus solely on increasing the value of client accounts, building strong client relationships and providing long-term service.

A financial planner earns the CFP® designation by meeting the education, examination, experience and ethics standards established by the Certified Financial Planners Board of Standards, Inc. (CFP Board) and passing examinations in subject areas such as insurance, securities and taxes. To maintain the designation, a CFP® practitioner must adhere to strict ethical and practice standards, complete certain continuing education requirements on an ongoing basis and pay a bi-annual licensing fee.
